Is it Legal to Live in Your Car? - Law and Daily Life - FindLaw

For many Americans who are down on their luck, their cars have become a permanent home away from home.

But not all localities are welcoming of what some lawmakers are calling "vehicle vagrants."

For those who intend on making their car a very cheap hotel, take these legal issues into consideration before living in your car:

Trespassing/Parking

For the most part, spending an extended period of time in your car isn't a problem -- you can sleep in your parked car in your driveway if you'd like. Rather, it's the fact that your car is in one spot for at least as long as you're sleeping in it.

Parking your car on someone's private property can get you arrested for trespassing, unless you have the owner's consent. And if you do, you might as well as to just crash on a couch.

If you park on a public street or in a neighborhood, you'll need to obey the parking laws, unless you want to continuously fight parking tickets. Remember that while an area may not have an hourly limit, cars that remain parked in one area long enough will draw the attention of law enforcement.

Vagrancy Laws

The U.S. Supreme Court in 1972 struck down a Florida municipal vagrancy law for vagueness, and since then most jurisdictions have abolished their general vagrancy laws.

However, your city may have specific laws relating to "vehicle vagrancy," which may make it a criminal offense to live in your vehicle without a permanent residence, even if you have permission to park there.

For example, lawmakers in upscale Palo Alto, California, are attempting to curb vehicle-dwellers in their city with a new ordinance that would make sleeping in cars a citable offense and relies on citizen reports for enforcement, reports the San Francisco Examiner.

Indecent Exposure and Loitering

Although most vagrancy laws have been put to rest, the practical necessities of living out of your car -- like getting dressed in your car -- may get you cited for indecent exposure.

The level of exposure necessary for indecent exposure varies from state to state. But in general, exposing your genitals to the public, even while changing your undies in the car, can potentially be considered a misdemeanor.

Loitering laws in different cities and states make it illegal for a person to remain in a public place for too long. New York law, for example, makes it illegal to sleep in a metro station; police or antagonistic citizens may try to use these laws to hassle you for spending the night in your vehicle.

Keep these laws in mind before making your car a temporary or permanent place to live.

The Unofficial Apple Weblog (TUAW): Lomography Smartphone Film Scanner an easy way to digitize 35mm negatives

Lomography has made a business out of trying to keep some of the old film technology alive, and they've been doing it for 20 years. To bridge the gap between the film and digital ages, they've come up with the Lomography Smartphone Film Scanner (US$59).

This post probably won't make sense to those of you who have grown up with digital photography, but there used to be a day when cameras used this stuff called "film." You'd stick it into your camera, take photos, then have them "developed" so that you could see your pictures on "prints." When you'd pick up your envelope of prints, the place where you got your photos developed was always kind enough to include your "negatives," which were the processed film strips. Want another print? Drop off the negative with your friendly neighborhood processing shop, and you'd get the print later -- for a fee, of course.

The Smartphone Film Scanner is a tiny lightbox with a feed mechanism for rolling through those strips of negatives. Put your iPhone (or other smartphone) on top of the device, align your phone's camera lens with the hole on the top of the device, fire up the free Lomoscanner app and start capturing images from the negatives. Note that you can also scan positive (slide) 35mm film, but unfortunately there's no way to scan mounted slides.

You'll need to put a pair of AA batteries in the scanner before starting. I used my Apple rechargeable AAs for this, and they worked just fine. You'll also want to remove the Lomokino adapter before scanning 35mm film -- it's used for scanning Lomokino movies, which are 144-frame 35mm movies shot with a special camera available from Lomography.

Turn on the backlight, fire up the Lomoscanner app and then feed one end of the 35mm film strip into the slot marked "Insert film here." Turn the little knob to feed the negative until it's framed properly, and then tap the shutter button to take your photo. Turn the knob again, take another shot, and so on until that shoebox full of negatives has been scanned.

If you have Photo Stream set up on your iPhone, all of those scanned images will show up in iPhoto or Aperture, ready for additional touch up. There are built-in app adjustments for exposure, contrast and color temperature, so if your negatives have faded, you can begin the process of making them look brand-new within the Lomoscanner app. Me? I think those slightly-off hues can be charming; after all, 5 billion Instagram users can't be wrong. You'll notice that the images seem grainy, but that's an artifact of the original film, not the scanning process.

A lot of users have given the Lomoscanner app negative reviews due to crashing; I only experienced that when I tapped the button to go into my Photo Library. My main concern was that images that were taken vertically on the film strip were cut off when zoomed in. I quickly learned to leave those images zoomed out, and to then use iPhoto to crop out the extraneous space around the images.

The Lomography Smartphone Film Scanner is a great way to digitize those 35mm film strips and get them into your Photo Library. If Lomography ever comes out with a version for scanning the thousands of 35mm slides I have, I'll be the first to buy it.

Coal ETF Investing 101 - August 2, 2013 - Zacks.com

Coal Industry Outlook

The increasing demand for utility services, particularly for electricity, is a primary driver for the demand of coal. Coal remains a dominant source of power generation worldwide. In the U.S. around 40% of the total power generation capacity is coal fired.

As per the World Coal Association (WCA), proven global coal reserves will last nearly 112 years at current production rates. On the other hand, proven oil and gas reserves are projected to last around 46 years and 54 years, respectively, at current production levels. Asia is the biggest coal market and presently accounts for 67% of the global coal consumption. (Read: Oil ETFs Surge on Strong Data)

Metallurgical coal or coking coal is used in steel production. So, the improvement in steel industry fundamentals improves the prospects of the premium variety of coal. The World Steel Association projected about 3% year-over-year growth in global steel usage in 2013 and 2014.

Despite the demand of coal for power generation and in other industries, there is an increasing global concern towards the emission of green house gases. President Obama?s Climate plan, which aims to lower carbon pollution in America, could impact the future prospects of the coal companies. (Read: Behind the surge in wind power ETF)

The President?s Climate plan calls for implementation of carbon pollution standards for both existing and upcoming coal-fired units that in a way could make coal-fired units more expensive and less attractive for operators. The electricity generators, in order to avoid the stringent regulation, could decide to erect power plants using natural gas or alternate sources, which will lower the demand for coal and impact the future profitability of U.S. coal companies.

However, with prices of natural gas going up in the U.S. and the expected surge in coal-fired units globally in the next few years, the demand for coal may improve. Second quarter earnings for the coal industry started on a positive note with Peabody handsomely surpassing the market expectation, resulting in a corresponding surge in coal ETF. Market Vectors Coal ETF (KOL - ETF report) in Focus

KOL tracks the Stowe Coal Index, providing exposure to companies related to the coal industry. Even though this index has a global focus, nearly 46% of its investments are directed towards U.S. companies, followed by China with a 13% share.

The Coal Index comprises companies that generate at least 50% of their total revenues from any form of coal related activities. The activities range from production and mining, coal transportation, production of coal mining equipment as well as coal storage.

The ETF launched in Jan 2008 presently has an asset base of $156.6 million. This fund holds 34 stocks and the top 10 companies hold a 58.73% share of total net assets.

The average daily volume is about 130,000 shares and the fund has a dividend yield of 2.32%.

Among individual holdings, top stocks in the ETF include CONSOL Energy Inc, China Shenhua Energy Company Limited, and Joy Global Inc. comprising 8.31%, 7.99% and 6.93%, respectively, of total net assets.

To Sum Up

Future prospects of the coal industry in the U.S. will be tied to shipments besides domestic demand. China and India are going to be the two major importers of coal. However, in the U.S. coal continues to lose its ground to other fuel sources for power generation.

Per the U.S. Energy Information Association, coal will continue to be the largest source of electricity generation, but its share in the pie, which was 51% in 2003, would decline to 35% in 2040. Renewable energy sources and natural gas powered units will be the main beneficiary of this lost ground. Even with its decreasing usage, coal will remain as a major source of power generation in the next few decades.

Indexes edge up as Fed slowdown fears ebb

NEW YORK (AP) ? Stocks are ending slightly higher after a report of tepid U.S. economic growth raised expectations that the Federal Reserve will continue its stimulus program.

The government lowered its estimate for growth in the first three months of the year to 2.4 percent from 2.5 percent.

Stocks slid last week on concerns that the Fed might slow its bond purchases.

The Dow Jones industrial average rose 21 points to 15,324 Thursday, or 0.1 percent. The Dow was up 95 points in the afternoon, then faded in the last hour.

The Standard & Poor?s 500 rose six to 1,654, or 0.4 percent. The Nasdaq rose 23 points to 3,491.

Three stocks rose for every two that fell on the New York Stock Exchange. Volume was average at 3.5 billion shares.

Stop #Slatepitching Insider Trading!

With the government pursuing a securities fraud case against Steve Cohen?s SAC Capital?though not, strikingly, against its founder and sole owner personally?the contrarians are coming out of the woodwork. From Time.com to Wonkblog, people are asking: Why ban insider trading in the first place? The great wheel of conventional wisdom appears to have turned, leaving Slate to state the obvious: The ban on insider trading does no harm, repealing it would solve nothing, and legalization could exacerbate the most dysfunctional tendencies in corporate America.

Lets start with what the would-be legalizers get right: The official rationale for the ban on insider trading makes no real sense. The pretense is that the ban helps create a level playing field, where the little guy can get a fair shake. This is nuts, because real traders and investment managers have millions of dollars to spend on research and analytics?the playing field can be as level as you like and you?re still going to get your ass kicked. Even perfect enforcement of Major League Baseball?s ban on performance-enhancing drugs isn?t going to help you strike out Alex Rodriguez. Under any rule set, only a crazy person would gamble on his ability to beat professional athletes at their own game.

The legalizers are right to bring this core truth to light. All across America, millions of people are wasting their money by going head to head against professional investors, and they should be encouraged to stop. You are not going to be able to pick stocks in a way that consistently outperforms the market average. The manager of your mutual fund isn?t either. Nor is your stockbroker. What?s more, anyone who could consistently beat the market would charge royally for his services and eat up your profits. And of course, you will not do a better job of picking a fund manager than you would do picking stocks in the first place. You, personally, should sit blissfully unaware of any information?whether insider or publicly available?and put your money in some nice low-fee index funds. Don?t trade. Don?t worry about insider trading.

And certainly don?t assume that legal action will somehow create a safer stock market for the small investor, or help middle-class retail investors get smarter about portfolio management. Legalizing insider trading will only open the door to new waves of rip-offs, as people get lured into funds purporting to offer access to insider information.

Legalized insider trading will also create huge management problems. As Jie Hue and Thomas Noe wrote in their analysis of the pros and cons of insider trading for the Federal Reserve Bank of Atlanta, the informational value of insider trading is low in any country with a sophisticated securities analysis industry. Allowing it mainly gives investors ?an incentive to substitute cheaper compensation based on insider trading for expensive salary packages designed to ensure high performance,? they write. So instead of cutting your CEO a huge check, you can let him profit from his insider information.

?At the same time,? they write, under the insider-trading system ?managers have an incentive to manipulate project returns to increase risk.? In other words, instead of spending their time managing their businesses for long-term growth, executives will be thinking about the optimal strategy for buying and selling their own company?s stock. This focus on financial markets would only intensify one of the worst trends afflicting the American economy today: that corporate investment has become de-linked from corporate profits. Until recently, corporate earnings and investments in equipment and software rose in lockstep, but more recently, surging profits haven?t fueled much new business spending?which has kept the job market sluggish despite strong earnings. A key culprit seems to be excessive management focus on short-term stock price movements as executive compensation has become more linked to market performance. Shifting to a world in which managerial pay is even more about share price manipulation will make things worse and worse.

Rather than pushing to legalize insider trading, we ought to consider other areas where consumer protection rationales fall short but the public interest still calls for tighter regulation. High-frequency trading outfits that use advanced algorithms and state-of-the-art computer infrastructure to exploit millisecond-long trading opportunities are sometimes said to hurt ordinary investors. The counterargument, as with insider trading, is that no number of regulations will change the fact that small investors are saps and the trades speed up price discovery. But as with insider information, the marginal value of speedier price discovery to America?s already sophisticated financial markets is extremely low. The harm, meanwhile, is in the diversion of effort. Just as we want executives focused on growing their businesses rather than timing trades, it?s unhealthy to have too much talent and resources devoted to algorithmic trading, which is a much more zero-sum game than normal programming or traditional market research.

Securities regulation is never going to turn the stock market into a level playing field, and we shouldn?t worry about whether or not it?s succeeding. The risk of lax rules, however, is that the stock market becomes a dangerous distraction from the real business of the economy. Laws against insider trading help stop that, they ought to be enforced, and they ought to be a model for looking at further curbs on speculative activity.

Gates shook her hand with just one hand. In South Korea, and much of Asia, that's only done in casual settings, with good friends. To top it off, Gates had his left hand in his pocket, signaling his superiority.

"How rude!" was the response in South Korea media. Almost every news organizations carried the photo on the front page.

The proper way to show respect would have been for Gates to clasp the South Korean leader's hand with both of his hands.

Was Gates sending a blunt signal of political disapproval to the new government leader? Was Gates ignorant of Asian etiquette??

There was enough media buzz that the South Korean president's office felt it needed to issue an official statement on the matter: "Bill Gates took a similar pose for a picture when he met former President Lee Myung-bak five years ago. Just think of it as an American style of greeting," according to Dong.com, the website of Dong-a Ilbo, a leading newspaper in Korea with daily circulation of more than 1.2 million.?

The first part of that statement is true. In fact, the Atlantic Wire compiled a series of Bill Gates One-Hand Shaking, One-Hand-in-Pocket photos from previous meetings with other world dignitaries, including UN Secretary General Ban Ki-moon, China's President Xi Jinping, and French President Nicolas Sarkozy.

Apparently Gates is consistently casual about his handshakes ? with whomever he meets.

While the one-handed Western handshake has become more common in Asia, business etiquette also suggests that one never looks directly in the eyes of the person you're meeting. An exception to that rule is the Philippines. And in many places, a bow is also part of the greeting.

In Cambodia, for example, if you meet a prominent businessman, the proper way to show respect is to place your palms together at chest height and bow at your waist.

There's also a culturally correct way to exchange business cards in Asia, too. Each card should be in English on one side, and the recipient's native language on the other. You present your card with both hands, native language side up and readable to the recipient. When you receive a card, it's also a two-handed affair. Look at it, thank the person, and put in gently in a coat pocket.

Luis Suarez has accepted the FA?s 10-match ban after deciding not to appeal the punishment for biting Chelsea defender Branislav Ivanovic.

Liverpool received the independent panel?s written reasoning for the length of Suarez? suspension and had until noontime Friday to contest ruling. In deciding against doing so, the 26 year old?will now miss the remaining four games of the Premier League season and the first six domestic games of next term, assuming he remains at Anfield.

The FA confirmed Suarez? decision to accept the ban in a statement: ?Liverpool forward Luis Suarez has not appealed the suspension issued to him by an independent regulatory commission this week.

?A three-person independent regulatory commission upheld the FA?s claim that a suspension of three matches was clearly insufficient and the player will now serve a further seven first-team matches in addition to the standard three.

?The suspension begins with immediate effect and applies to Liverpool FC?s next 10 domestic first-team fixtures.

?The FA intends to publicise the independent regulatory commission?s written reasons in due course.?

Liverpool?s managing director, Ian Ayre, and manager, Brendan Rodgers, have both been vociferous in noting their discontent with the FA?s decision and ?the differing standards that have been applied across various previous incidents.? Nevertheless, both men claim they respect the FA and accept the decision.

Only time will tell the ultimate implications of Suarez? ban. The striker is?reportedly considering his future in the English game after the regulatory commission?s punishment is said to have left him feeling distraught. Merely one week ago the Uruguayan pledged his loyalty to the Anfield club but the events of past week mean Suarez may now be?open to offers from his list of admirers, which includes Bayern Munich, Atl?tico Madrid and Juventus.

On Friday morning Suarez issued the following statement over?Twitter: ?I am truly very sorry about the incident with Branislav Ivanovic. I hope that all the people who I have offended at Anfield last Sunday will grant me forgiveness. I know that all the things that are happening to me in England will help me improve my conduct on the field. Right now I just want to focus on becoming a better footballer on and off the field.

?I would like to explain to everybody that I decided to accept the ban because whilst 10 games is clearly greater than those bans given in past cases where players have actually been seriously hurt, I acknowledge that my actions were not acceptable on the football pitch so I do not want to give the wrong impression to people by making an appeal. I really want to learn from what has happened in the last two and a half years, many things have been said and written about me, I just tried to do my best on the field. I hope to come back early to play. Luis Alberto Suarez.?

If Suarez does decide to leave England in the summer, Liverpool could be forced to accept a reduced sum for his services as the biting incident ? in addition to his ban for racially abusing Patrice Evra ? has left him one of world football?s biggest liabilities. What?s more, Suarez can expect that any club that decides to sign him will?be sure to include strict contractual provisions outlining financial ramifications that will result from any future bans or suspensions the player may receive.

STALEY, N.C. ? The Liberty Antiques Festival officially kicked off Friday morning at Pike Family Farms in Randolph County.

A tradition for antique collectors across the country, more than 400 vendors have spent the week setting up booths at the festival.

Buyers and sellers from more than 25 states are expected to attend the festival, which runs from 8 a.m. to 5 p.m. Friday and Saturday at 2855 Andrews Road in Staley.

Promoters Mary Ellen and Vito Sico and Janet Hill promise 18th to 20th century furniture and accessories, pottery, glass, clocks, dolls, toys, military items, advertising, decoys, jewelry, quilts, folk art and ?in the rough? country Americana.

?No crafts or reproductions,? they added.

There was a long line forming Friday morning as folks waited for the gates to open.

Admission is $7 per person.? There is no cost for children under 12 years old.? Parking is free.

Red Epic Dragon sensor updates start tomorrow for $8,500, watch the actual process at NAB

Red has announced that Dragon sensor updates will start tomorrow for Epic-M and Epic-X owners and, interestingly, is letting owners (and the public) see the operation for themselves at its NAB booth. The new sensor will bring 6K resolution, 120 fps at 5K and 15+ stops of dynamic range in a slightly larger format, according to Red. Early adopters will be able to pre-order now for $8,500, while Epic owners who wait until Thursday or later will be able to grab the update for $9,500. Filmmakers hoping for a new Epic-M with the Dragon instead of the Mysterium-X sensor will be able to pre-order tomorrow for $29,000 or so. Meanwhile, there's good news for those with the more budget-minded Scarlet -- they'll be able to upgrade to the Epic directly or get a 6k Dragon sensor and ASICs, with pricing details coming tomorrow and pre-orders launching on Thursday. US, Russia vie for largest natural gas reserves

The United States, currently one of the world's largest sources of natural gas, may find itself fending off increasingly stiff competition in the resource's development, as the move to tap natural gas supplies goes global.

Considered by energy watchers to be one of the most promising avenues of energy development, natural gas is cleaner, more abundant and relatively less expensive than regular gas. The resource is being used in an ever-increasing array of activity, from generating electricity to powering locomotives and public transport ? which is putting upward pressure on market prices.

Fewer regions have moved to harness natural gas as aggressively as the U.S., which accounts for more than a fifth of global natural gas consumption, according to data from the Worldwatch Institute, an environmental think-tank.

Still, global interest in the fossil fuel is on the rise as countries like Russia and Qatar move aggressively to tap their natural gas resources, with others like Israel following suit. The global interest poses a challenge to the U.S.'s growing clout in the sector.

In addition to international oil giants like Norway's Statoil and Chevron exploiting natural gas, Australia and countries in Africa and South America "are discovering gigantic fields all over the planet," said Richard Hastings, senior macro strategist at Global Hunter Securities. Development is "very robust and competitive," he added.

America's energy revolution has been in part hampered by a reluctance to ship its natural gas bounty to other countries. According to the U.S. Energy Information Administration, Russia and the U.S. are running neck and neck for the title of the world's largest natural gas reserves.

Yet unlike the U.S. ? which is currently embroiled in a contentious debate about selling its natural gas stocks abroad ? other countries harbor little compunction about exporting the fuel to other resource-hungry nations.

Although the U.S. is one of the largest producers of natural gas, data from the CIA World Factbook lists the U.S as a distant challenger to natural gas export powerhouses like Russia, Qatar and Canada. Should the world's largest economy fail to sell more to other countries, analysts say it could put the U.S. at a disadvantage.

Global natural gas markets are highly competitive "except for captive markets like Russian sales to Europe," said John Felmy, chief economist of the American Petroleum Institute in Washington. "The U.S. being the largest producer of natural gas, it has the ability to be able to make some money off it."

The reluctance to export natural resources undercuts what analysts say is one of the U.S.'s major competitive advantages: generous mineral rights that make it relatively easy for companies and private citizens to drill with little interference from the government.

U.S. policy differs from other countries, where governments tightly control surface and mineral ownership, therefore restricting drilling and exploration. In Europe, a patchwork of European Union and local regulations are a barrier to natural gas exploitation.

"In terms of the development of the natural gas industry, what the U.S. policy make up does is allows the individual to benefit," said Matt Lucky, a sustainable energy fellow at Worldwatch Institute. That allows major energy companies and private landowners to exploit valuable mineral rights beneath their land, he said.

That distinction "has helped to drive exploration in the natural gas sector in the United States. A lot of people have become very wealthy in the U.S. by mineral rights," Lucky said. "That's not the case in in much of the rest of the world."
